Terms of Service

1. Agreement to Terms

These Terms govern access to AetherLab's websites, AI risk assessments, guardrails, APIs, documentation, and related services (the "Services"). By using the Services, you agree to these Terms. If you use the Services for an organization, you represent that you have authority to bind that organization.

Commercial Services may also be governed by a signed master services agreement, order form, statement of work, or similar agreement. That written agreement controls if it conflicts with these Terms.

2. Use of Services

Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms and any applicable written agreement. You may not interfere with the Services, attempt unauthorized access, evade usage limits, use the Services to violate another person's rights, or test AetherLab systems for vulnerabilities without written permission.

Account Responsibilities

  • Keep credentials and API keys confidential
  • Provide accurate account and billing information
  • Remain responsible for activity under your account
  • Notify us promptly of suspected unauthorized access

3. Intellectual Property

AetherLab and its licensors retain all rights in the Services, including software, assessment methods, documentation, designs, and trademarks. Subject to these Terms and any applicable written agreement, AetherLab grants you a limited, non-exclusive, non-transferable right to use the Services during the applicable service term.

You retain ownership of content you submit. You authorize AetherLab and its service providers to process that content as necessary to provide, secure, support, and maintain the Services.

4. Data and Privacy

Our Privacy Policy describes how we handle personal information and customer content. AetherLab does not use customer content to train AetherLab models. Additional security, confidentiality, retention, or data-processing commitments apply only when included in a written agreement.

5. Fees and Payment

Fees, billing cadence, taxes, expenses, refund terms, and any usage commitments are stated in the applicable order form, statement of work, or other written agreement. The public website does not create a price or payment commitment.

6. Service Availability and Changes

We work to keep the Services available and reliable, but features may change as the Services evolve. Any uptime, support, response-time, or service-credit commitment exists only if stated in an applicable written agreement.

7. Assessment and Evidence Limitations

Assessments, guardrail results, and Evidence Packs provide information for risk decisions; they do not guarantee that a system is free from vulnerabilities or future failures. They are not legal advice, regulatory certification, insurance coverage, or a substitute for your own testing, governance, and professional judgment. Findings may reflect the system, configuration, and information available at the time of review.

8. Third-Party Services

The Services may interoperate with third-party models, infrastructure, links, or tools. Third-party services are governed by their own terms and privacy practices. AetherLab is not responsible for third-party services outside our control.

9. Disclaimers

Except for commitments expressly stated in a written agreement, the Services are provided "as is" and "as available." To the extent permitted by law, AetherLab disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the extent permitted by law, neither party will be liable under these Terms for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Any different liability allocation in an applicable signed agreement controls for the Services covered by that agreement.

11. Suspension and Termination

AetherLab may suspend access reasonably necessary to address security threats, unlawful use, nonpayment, or a material breach. Commercial service terms, termination rights, and post-termination data handling are governed by the applicable written agreement and our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict-of-law principles. Any dispute-resolution provision in an applicable signed agreement controls for that agreement.

13. Changes to Terms

We may update these Terms as the Services or legal requirements change. We will post revised Terms here and update the date above. Material changes apply prospectively, and we will provide additional notice when required by law or contract.
